Website Services – Terms & Conditions

These Terms & Conditions explain what is included when you engage us to create and manage your business website. We aim to keep things simple, clear and fair.

1. Website Service

We provide a basic business website of up to three pages, unless otherwise agreed.

The website may include items such as:

  • Business information

  • Services

  • Contact details

  • Images and branding

  • Links to booking systems, social media or other external websites

Any additional pages, functionality or substantial changes outside the agreed website may be quoted separately.

2. Monthly Service

The website is provided and managed for an agreed monthly fee.

The monthly service includes hosting and general management of the website together with reasonable minor updates.

Minor updates may include things such as:

  • Updating contact details

  • Small wording changes

  • Replacing an existing image

  • Updating business hours

  • Updating an existing link

Changes that significantly alter the design, layout or functionality of the website are not considered minor updates.

If additional work is required, we will discuss it with you and agree on any additional cost before completing the work.

3. Information and Content

You are responsible for making sure the information you provide to us is accurate and that you have permission to use any text, photographs, logos, trademarks or other material you provide.

We may assist with wording, images, layout and presentation where agreed.

You are responsible for reviewing the website and letting us know if anything is incorrect or needs changing.

4. Domain Name

Where a domain name is registered for your business, the domain will be registered using your business or organisation's eligible details rather than ours.

For Australian domains such as .com.au, eligibility requirements are determined by .au Domain Administration (auDA). An active ABN or ACN is one common way businesses qualify for a .com.au domain.

You remain the owner/registrant of your domain name.

We may assist with registering, configuring or managing the domain and may act as an administrative or technical contact where appropriate.

You are responsible for ensuring your domain registration remains current and is renewed when required.

We are not responsible for the loss or interruption of a domain caused by a failure to renew the domain or maintain accurate registration information.

5. Third-Party Services

Your website may use or link to services supplied by other companies.

These may include services such as:

  • Website hosting platforms

  • Domain registrars

  • Google Maps

  • Google Analytics

  • Social media platforms

  • Online booking systems

  • Payment providers

  • Email or contact services

These services are operated independently from us.

We cannot guarantee that a third-party service will always remain available, operate without interruption or continue offering the same features or pricing.

Where appropriate, we will assist with configuring or connecting these services.

6. Privacy and Customer Information

Some third-party services used by a website may collect information from visitors, for example through analytics, booking systems, contact forms or other integrated services.

Where your business collects personal information, you are responsible for ensuring that your business meets any privacy obligations that apply to it.

Not every Australian small business is automatically covered by the Privacy Act. Generally, the Privacy Act applies to organisations with annual turnover above $3 million, as well as some businesses that fall into specific categories.

7. Website Availability

We will take reasonable care in creating and managing your website.

However, websites rely on internet services and third-party platforms, so uninterrupted availability cannot be guaranteed.

Occasional outages, maintenance, platform changes or technical issues may occur outside our control.

8. Search Engines and Business Results

We do not guarantee:

  • Google rankings

  • Search engine placement

  • Website traffic

  • Customer enquiries

  • Sales

  • Revenue or other business results

We will build and manage the website using reasonable practices, but website performance depends on many factors outside our control.

9. Payment

Monthly fees are payable according to the agreed billing arrangement.

If an account becomes overdue, we may temporarily suspend website management or website services until the outstanding amount is paid.

We will make reasonable efforts to contact you before doing so.

10. Cancelling the Service

There is no long-term contract unless otherwise agreed.

Either party may cancel the monthly website service by providing 30 days' written notice.

Any outstanding amounts must be paid before the service ends.

11. Leaving or Moving to Another Provider

You are free to move your website services to another provider.

Your domain remains yours.

Provided your account is paid up to date, we will reasonably assist with transferring relevant website or domain access required for you to move to another provider.

Some website platforms have their own technical limitations regarding transferring websites between platforms. Where a direct transfer is not technically possible, another provider may need to recreate parts of the website.

12. Our Responsibility

We will provide the service with reasonable care and skill.

We are not responsible for losses caused by matters reasonably outside our control, including third-party platform outages, internet failures, changes made by third-party providers or information supplied incorrectly by the client.

Nothing in these Terms & Conditions excludes any rights or guarantees that cannot legally be excluded under Australian Consumer Law.

13. Changes to These Terms

We may occasionally update these Terms & Conditions as our services change.

Any significant changes affecting an existing service will be communicated to you.

14. Acceptance

By submitting the website service request and selecting the acceptance checkbox, you confirm that you have read and agree to these Website Services – Terms & Conditions.
